Article 1: Scope of Application

These General Terms and Conditions of Sale (hereinafter the “GTC”) apply without restriction or reservation to all orders of products and services placed with Vintage Pare-Chocs via the website :  

www.vintage-parechocs.com, by email, by telephone, or by post.

They are effective from the date they are published online and prevail over any other conditions, unless otherwise agreed in writing by Vintage Pare-Chocs. Placing an order implies full and unconditional acceptance of these GTC by the customer.

Article 2: Availability of Products and Services

Products are offered while stocks last and, for non-stocked items, subject to availability from suppliers or manufacturing facilities of Vintage Pare-Chocs France.

Due to the artisanal nature and small-batch production of certain products, temporary or permanent unavailability may occur. Such unavailability shall not engage the liability of Vintage Pare-Chocs France.

In the event that one or more products become unavailable after order confirmation, the customer will be informed as soon as possible by email or telephone. Any corresponding amounts will be refunded without undue delay, without any additional compensation being due. Services are performed in accordance with the confirmed order.

Article 3: Orders

Orders may be placed as follows:

  • via the website : www.vintage-parechocs.com (24/7);
  • by email at :  info@vintage-parechocs.com;
  • by telephone : at +33 9 78 80 59 73;
  • at trade shows, fairs, or commercial events attended by Vintage Pare-Chocs;
  • by post at : Vintage Pare-Chocs – 21 rue de Négron, ZI Les Poujeaux, 37530 Nazelles-Négron – France.

Online orders are confirmed by email, provided the customer supplies a valid email address. A telephone number is recommended to facilitate order tracking.

Any “express”, custom, or made-to-measure order may be subject to additional charges.

Orders are firm and final upon validation and must be paid in full at the time of ordering, regardless of the sales channel. Quotations and pro forma invoices are valid for thirty (30) days from issuance.

Article 4: Pricing

Prices are stated in euros (€), inclusive of all taxes (VAT included), excluding delivery and handling costs. For identified professional customers, prices may be displayed excluding VAT.

Applicable prices are those in effect on the date the order is placed. Vintage Pare-Chocs reserves the right to modify prices at any time.

Prices include VAT at a rate of 20% for customers located in France. In accordance with applicable regulations, customers residing in another EU Member State are subject to the VAT rate applicable in their country of residence.

For orders shipped outside France, customs duties, local taxes, or import charges may apply and remain the sole responsibility of the customer.

Article 5: Payment

Payment methods accepted:

  • Credit card (Visa, Mastercard, etc.) via a secure payment platform;
  • PayPal;
  • Bank transfer.

Credit card payments are debited upon order confirmation. Vintage Pare-Chocs does not have access to or store any banking data. In accordance with applicable law, cash payments exceeding €1,000 are not accepted.

In case of late or non-payment, penalties will automatically apply based on three times the legal interest rate, plus a fixed recovery fee of €40, without prejudice to additional damages.

Article 6: Delivery

Products are delivered to the address provided by the customer at the time of ordering. Delivery costs are borne by the customer and depend on weight, volume, and destination.

Delivery times are indicative and may vary due to artisanal production, manual finishing, and transport constraints. Delays beyond the control of Vintage Pare-Chocs shall not entitle the customer to cancel the order or claim compensation.

For deliveries outside mainland France, the customer is responsible for import formalities and payment of applicable taxes.

The customer must inspect the condition of the parcel upon receipt and report any issues to the carrier, as well as notify Vintage Pare-Chocs within twenty-four (24) hours. Any significantly damaged parcel must be refused.

Article 7: Product Sales

7.1 Right of Withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, consumers have a fourteen (14) calendar-day withdrawal period from receipt of the product.

This right does not apply to custom-made or personalized products, or items manufactured according to customer specifications, pursuant to Article L221-28.

Returned products must be unused, unmounted, in their original undamaged packaging, and accompanied by a copy of the invoice. Return costs and risks are borne by the customer.

If the withdrawal is valid, Vintage Pare-Chocs will refund the amounts paid (excluding return costs) within fourteen (14) days of receipt of the goods or proof of shipment.

7.2 Custom Products

Orders for custom-made products produced according to customer specifications are final upon order confirmation and full payment.

Such products are not eligible for withdrawal rights under Article L221-28.

No exchange, cancellation, or refund shall be accepted except in the case of proven manufacturing defects attributable to Vintage Pare-Chocs.

The customer is responsible for ensuring the accuracy of provided specifications. Vintage Pare-Chocs shall not be held liable for errors in customer-provided data.

7.3 Non-Conforming or Defective Products

In case of non-conformity or proven defect attributable to Vintage Pare-Chocs, the customer must notify the company within fourteen (14) days of receipt.

After inspection, the product may be replaced or refunded at the company’s discretion. Return costs may be covered up to the original shipping cost.

Article 8: Warranty

Products benefit from statutory warranties under French law, including the legal warranty of conformity and warranty against hidden defects.

The warranty is strictly limited, at Vintage Pare-Chocs’ discretion, to replacement or refund of defective products, excluding labor, installation, adaptation, vehicle immobilization, or indirect damages.

Products are aftermarket reproductions and not original manufacturer parts. Minor variations may exist due to manufacturing tolerances of older vehicles.

The warranty does not cover:

  • incorrect or improper installation;
  • modifications, misuse, accidents, or improper maintenance;
  • normal wear and tear.

Any lifetime anti-corrosion warranty applies only to the original purchaser and is non-transferable.

Article 9: Personal Data

Personal data collected is necessary for order processing and is handled in compliance with applicable data protection regulations.

Customers have the right to access, correct, and delete their data by contacting Vintage Pare-Chocs.

Article 10: Limitation of Liability

Images, descriptions, and information on www.vintage-parechocs.com are indicative and non-contractual. Minor differences may occur between displayed visuals and delivered products.

Vintage Pare-Chocs shall not be liable for damage resulting from improper use, incorrect installation, or modifications by the customer or third parties.

Liability is strictly limited to the value of the order. Under no circumstances shall the company be liable for indirect damages such as loss of profit, loss of opportunity, vehicle downtime, or commercial loss.

The company shall not be liable in cases of force majeure as defined by French law.

Article 11: Intellectual Property

All content on www.vintage-parechocs.com remains the exclusive property of Vintage Pare-Chocs and may not be reproduced without prior written authorization.

Products remain the property of Vintage Pare-Chocs until full payment is received.

The company reserves the right to request any documentation necessary to prevent fraud.

Article 12: Disputes – Governing Law

These GTC are governed by French law.

In accordance with the French Consumer Code, consumers may use a free consumer mediation service to resolve disputes amicably.

If no amicable solution is reached within thirty (30) days after a written complaint, the customer may refer the matter to the competent mediator.

Failing amicable resolution, disputes shall fall under the exclusive jurisdiction of the courts of Tours, France.

Article 13: Customer Acceptance

Validation of an online order, online payment, signing of a purchase order, or purchase made at a trade show or commercial event constitutes full acceptance of these General Terms and Conditions of Sale.

The data recorded by Vintage Pare-Chocs constitutes proof of transactions and operations carried out with the customer.
